Agreement to terms

By downloading, installing, or using BeachSpot, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

Description of service

BeachSpot is a mobile application that provides real-time beach parking availability information through crowdsourced user reports. BeachSpot does not own or operate any parking lots.

User accounts

Account creation: You may use BeachSpot as a guest or create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials.

Username: Usernames must be 3–20 characters, contain only letters, numbers, underscores, or hyphens, and must not include offensive language. We reserve the right to remove usernames that violate these rules.

Account termination: We reserve the right to suspend or terminate accounts that violate these terms or submit false reports.

User-generated content

Parking reports: When you submit a parking availability report, you confirm that the report reflects actual conditions you have personally observed. Submitting false reports may result in account suspension.

License: By submitting reports and content, you grant BeachSpot a non-exclusive, worldwide, royalty-free license to use and display that content as part of the service.

Lot owner terms

Listing accuracy: Lot owners are responsible for ensuring that their listing information is accurate and up to date.

Subscriptions: Lot owner subscriptions are billed monthly or annually and automatically renew unless cancelled before the renewal date.

Refunds: Subscription fees are non-refundable except where required by law.

Prohibited conduct

You agree not to:

• Submit false or misleading parking reports
• Manipulate the leaderboard or gamification system
• Use the app for any unlawful purpose
• Attempt to reverse engineer or modify the app
• Create multiple accounts to circumvent restrictions
• Harass or harm other users
• Impersonate BeachSpot staff or other users

Disclaimers

Parking availability: BeachSpot provides crowdsourced parking information and does not guarantee the accuracy of any availability reports. We are not responsible for inaccurate or outdated information.

No parking guarantee: BeachSpot does not guarantee that parking will be available at any listed lot. We are a discovery and reporting tool only.

“As is” service:The app is provided “as is” without warranties of any kind.

Limitation of liability

To the fullest extent permitted by law, BeachSpot shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Governing law

These Terms shall be governed by the laws of the State of South Carolina. Disputes shall be resolved in the courts of Horry County, South Carolina.

Changes to terms

We reserve the right to modify these terms at any time. Your continued use of BeachSpot after changes take effect constitutes acceptance of the revised terms.
